CPR Training Frequently Asked Questions
Who exactly is required to take Civil Procedure Rules training? Who must take Tier I and who must take Tier II? Can support staff take this training?
As per regulations, all Practising Members and all articled clerks must take Tier I training. All Practising members who reported 20% or more (combined) of Civil Litigation, Admin Law and Family Law on their 2008 Annual Members Report, and all Articled Clerks, must take Tier II training. The NSBS will not be providing training to support staff for the new Civil Procedure Rules.
How do I take the Civil Procedure Rules Tier I Training?
The Nova Scotia Civil Procedure Rules (2008) Training Materials are available on the Society Website in PDF format. The training materials are used as the basis for the self-study program for Tier I.
How do I access the test and when is it available?
The test is designed to be completed online. It is a 40-question multiple choice, open book test and the passing grade is 70%. The test will be available in early October. Once the test is available, an email notice will be sent to the NSBS membership with specific instructions.
The NSBS says I am required to take Tier II training, but I don't think this is correct. Is there any way I can have this requirement waived in my case?
The current regulations state that anyone who reported 20% or more (combined) of Civil Litigation, Admin Law and Family Law on their 2008 Annual Members Report are required to take Tier II training. An amendment to the regulations is planned to take care of any possible exceptions. The amendment would give the Executive Director the ability to waive the requirement to take Tier Two training in certain circumstances (for example, residing out of province). This amendment is to be passed in October. Membership will be contacted to inform them of its passing. I am required to take Tier II training and must complete Tier I in advance. How do I ensure I get access to the test in time to complete the Tier II training I have already registered for?
Priority access to the Tier I test will be provided to practitioners who are required by regulation to complete the in-person Tier II. Access to the test (username/password) will be provided in groups and therefore members will be notified when the test will become available.
There were only a few Halifax dates advertised for Tier II Training. Has this changed?

I am unable to complete the test online. How do I take the test?

The NSBS says I am NOT required to take Tier II training, but I would like to take it anyway. May I enroll for the Tier II training even if I am not in the Tier II group, as outlined in the regulations?
Yes, you may take the Tier II training even if you are not required by regulations to do so, provided you are a Practising Member. Class sizes are limited, however, and preference will be given to those who must take the training according to the Regulations.
I am currently a Non-Practising member of the Society, with plans to return to the Practising Member category in the future. Will I be able to take the CPR training now, or will I be required to take it when I change category? Will I need to do Tier I or both Tiers? How is that determined?
Yes, you may take the training if you wish. We cannot tell you what will be required of you when you return to practicing status until we know when you will be returning. If you return to practicing status while Tier I and II are being offered you will most likely have to take the training.
I am currently a Practising member of the Society, but I became a Practising Member after the 2008 Annual Members Report was completed, so I didn't submit one. Am I required to take Tier II training?
If you are required to take the Tier II training you would have received an email from the Society on Friday, September 26, 2008.
I am currently a Practising member of the Society, but I've changed employer since I filled out the 2008 Annual Members Report, and my breakdown of practice is not the same as it was when I filled out the AMR. Am I still required to take the Tier II training, even though my practice is not the same as was reported on the AMR?
Unless you apply for a waiver and are granted the waiver, you will still be required to take the Tier II training. Email Jacqueline Mullenger at jmullenger@nsbs.org.
The NSBS says I am required to take the training. What are the consequences if I do not complete the training as required?
As per the Regulations, you may not practice in those areas of law unless you complete the training and a surcharge added to your membership dues until the training is completed as required.
